Appellant appealed from a domestic violence order entered, alleging the family court erred by considering hearsay testimony and that there was no other substantial evidence supporting entry of the DVO. Vacated and remanded with directions to dismiss the petition.
Evidentiary and other issues
The appellant was convicted of, among other things, first-degree assault and first-degree unlawful imprisonment of his girlfriend. On appeal, the appellant contended that the trial court erred by: 1) admitting unduly prejudicial photos and 2) denying his requested instruction on imperfect self-defense. Finding no reversible error, the Court affirmed the judgment of the Circuit Court.
